DAY 33
20th March 2003
Hello everyone!
By popular demand... I'm B-A-C-K!! Praise the LORD! But only for a short time...
Even though there were no witnesses on the stand today, the Judge and the barrister for the Defence as well as the Crown were in discussions throughout the day.
Acting Judge Davidson has made a statement that Adrian Newell should be referred back to the Registrar with reference to the Supreme Court pursuant to Section 203 of the District Court Act 1973 for determination of whether Adrian Newell is guilty of Contempt of Court. (See daily report 25 of 11/3/03 where Newell (after being warned by the Judge not to talk to anybody about the case, rang the Catt girl just hours before she was to give evidence in Court that day. See also daily report 20 of 4/3/03 where Newell was observed talking to other Crown witnesses outside the Court room).
The Judge wants a list of witnesses and their evidence at the other trials and commented there have been a number of versions given on oath and is a significant matter.
With regard to Defence witness Patricia Roy, the Judge has insisted the Crown ensure her safety and that she be accompanied on her return to her property by Port Macquarie police. They will also take statements in relation to the latest robbery. (See daily report 31 of 18/3/03).
Defence barrister, Andrew Martin will prepare his summing up for when the Inquiry resumes on the 9th April.
Please pray God's guidance upon the barrister as he prepares his submission and the Wisdom of the Lord upon the Judge. Also continue to pray for Roseanne and her family - that she will finally be free of the heavy burden she has been carrying all these years.
Roseanne asked me to send her heartfelt thanks and appreciation to everybody who has been supporting her in prayer as well as those who have given support by kind words of encouragement. Hallelujah! Thank you Lord, your Will be done on earth as it is in Heaven... Amen!

DAY 32

The case for the defense is not yet closed.
Court resumes for this matter on 9th April.
Defense can still call/recall more witnesses if need be.
Witness Patricia Roy
- Crown continues its cross-examination of content of her affidavit dated 2/05/2002.
Judge asked for details of a few of the assaults noted in her statement.
1 PR named 2 witnesses to an incident when Barry Catt kicked her in the back and pulled her hair.
2 Two farm helpers saw one assault. She rang the police on her mobile. Judge asked witness "Was he charged"... "no"... "The reason police gave?"... " Barry Catt told police he wasn't there 'denied being on the property'.
3 Attacked on her property by Barry Catt with an iron bar across the side of the head. Two of her workers were on the roof came to her aid.
4 Another incident was recalled. "She had her arm around a woman who was carrying a 15month old baby during the attack". Crown asked why this one was reported, when she hadn't bothered to report other incidents? "This was a very violent assault", was her reply and she "had no faith in the Taree police".
5 She was sitting on a verandah of a house opposite Barry Catt's workshop, having coffee with a couple and their two children (aged approx 5 & 6) Barry Catt put a 20 litre drum on the ground near the verandah. It was next to a tap. They thought he was going to put water in it. She said he likes to make acetylene bombs in coke cans. He had a coke can in his hand. He ran back to his workshop - there was a very large noise, shrapnel in the form of pieces of metal landed on the verandah. Her friend's child had to go to the doctor for ear deafness. Judge asked, "did he seem to be affected by liquor? "no, he was laughing, thought it was funny".
The witness gave the names of police whom she had made contact with after various assaults but they did nothing to help her.
More questions re the private video made of Roseanne's arrest. She said you could see Barry Catt and a woman on the tape because they turned the camera around towards them. You can hear them laughing and joking about Roseanne's arrest.
Judge told the Crown to contact Taree police to ensure the police take action to her complaints. Rogers acting for Defense stated he had been with this witness in Foster and spent hours with police trying to organize protection. It was declined two days ago"
Judge continued saying that if a citizen gives information of repeated assault and gives independent sources of inquiry then I would expect some sort of action to be taken to follow this up... not just witness protection.
Mr Graham Fellows (recalled) He heard Barry Catt talking to a man in his workshop "she's in jail and she won't get out I'll have her killed in jail", which he then reported to a police detective.
At one time he said Barry Catt asked him to get him a gun. "he wanted a gun to kill her if she got out" (said to Graham approx 4 yrs ago)
One month before he was bashed up, Barry Catt had pointed a gun to Graham Fellows head.
He said Barry Catt had arranged for someone to go to Patricia Roys farm and ransack it.
Third witness for Defense. told how she was asked to injure Roseanne while they were both in jail. She was asked to "put Rosanne in hospital, for a sum of money", "bad enough to keep her in hospital, if you happened to kill her accidentally they will put more in your account." "She (Marie Whalen), said she had very influential friends". Barry Catt's name was mentioned. Roseanne was described to her as an evil witch. At this point she had not met Roseanne, however when she did she was "very surprised she was not the picture she had painted"... "no way.."
